A Change for H1B Applications: A new labor certification process

Before an H1B application can be submitted to the Immigration and Naturalization Service, foreign labor certification must be obtained from the US Department of Labor (DOL). The old method for labor certification was to either fax or send the foreign labor certification (ETA 9035) form to the DOL. The DOL is changing a few of the methods to this procedure beginning on January 19, 2001.

Beginning on January 19, 2001 a new three page ETA 9035 form will replace the old one page form, and no old forms will be accepted. The new form can be downloaded from the DOL’s web site at www.ows.doleta.gov . Although the new form will be available, the DOL requests that employer’s and representatives wait to send any ETA forms until February 5, 2001. The gap time will be used to process the old forms that were submitted before January 19.

If the ETA form must be submitted during the period between January 19 and February 5, then it can be sent to the appropriate ETA Regional Office, or to Philadelphia at P.O. Box 13640, Philadelphia, PA, 19101. After February 5, the forms can either be mailed or faxed to (800) 397-0478. The DOL will continue to either mail or fax responses to employers, but will only fax responses to employer representatives.
